      • abstract<p style="text-align: justify;">The contributions are divided into three themes. The first theme concerns the search for transnational justice. These contributions deal with the problems caused by the growing interdependence between national states. A second set of contributions focuses on the changing position of the courts in a system of multilevel governance and the democratic basis for this change. The third group of articles, finally, deals with several basic concepts of law and society which may be used to describe the shifts in governance, while focusing on the role of private autonomy at different levels of government.</p>

      • abstract<p style="text-align: justify;">This book deals with the judgments of the supreme courts of a number of Member States which determine the constitutionality of some part or parts of implementing legislation by which the EU Framework Decision on the European Arrest Warrant (EAW) was transposed into national law.The Framework Decision, adopted in June 2002, seeks to change the mechanism by which individuals sought for trial or punishment in one Member State, but who are present in another Member State, are made available to the Member State which seeks to try or punish them. This mechanism has traditionally been called extradition and has been the subject of international agreements. According to the Framework Decision, individuals, including nationals of the state, must be surrendered to the authorities of other Member States for trial or punishment in respect of a specified list of offences on a warrant issued by the authorities of the seeking state.</p>

      • abstract<p style="text-align: justify;">In this contribution, I aim to describe the influence of the Market Abuse Directive on the organization of administrative and criminal law enforcement and, particularly, how this impacts on transnational cooperation. On a national level, administrative law enforcement (financial supervision) and criminal law enforcement are often closely related. How this relationship is given shape exactly, differs from one country to another. This may have an impact on transnational cooperation. Whereas in transnational cases requests for mutual administrative assistance are necessary for administrative law purposes, for criminal law enforcement purposes requests for mutual assistance in criminal matters (or judicial assistance) are needed. Does this distinction between mutual administrative assistance and mutual assistance in criminal matters pay due respect to differences in national law enforcement in the field of insider dealing?</p>
