      • abstract<p style="text-align: justify;"><span style="color: rgb(31, 31, 31); font-family: Alegreya; font-size: 17px; line-height: 27px;">During the 1970s the European States developed intergovernmental initiatives to address terrorism. First, within the framework of the European Political Cooperation dealing with foreign policy issues, a working group was set up to examine the political and legal aspects of international terrorism. A second initiative became known under the acronym TREVI, short for “Terrorisme, Radicalisme, Extremisme et Violation International”, set up to enhance the information exchange on terrorist groups. The Maastricht Treaty incorporated these two initiatives in the EU system, replacing the European Political Cooperation with the Second Pillar dealing with Common Foreign and Security Policy, and integrating TREVI in the Third Pillar dealing with Justice and Home Affairs. Prior to September 11, the EU mainly dealt with terrorism in the Third Pillar viewing it as a criminal justice issue, rather than an aspect of foreign policy.</span></p>

      • abstractThis contribution discusses the Lisbon Treaty in the context of criminal law and examines the similarities and differences between this Treaty and the Constitution. In doing so the paper asks whether the constitutional architecture as drawn up by the Lisbon Treaty constitutes a sufficient solution for the notion of European criminal law. Hence the paper looks at the possible challenges in the present area and thereby also the meaning of the Union’s proclamation of European values in the current wave of the increased focus on security aspects within the EU.

      • abstract<p style="text-align: justify;">Though always present in penal codes, offenses based on belonging to a criminal organization occupy a vanguard position in today's evolution of penal law systems: organized crime is located at one of the most prominent places in the criminal policy agenda. Nevertheless, neither criminal law theory nor the actual content of criminal provisions nor the putting of theory into practice enables an adequate restriction of the interpretation of the laws against criminal organizations. Therefore we need to investigate the wrongfulness at the base of this offense. European legal scholarship has proposed two basic approaches: to consider that this offense anticipates the possibility of punishing and prosecuting such behavior (anticipation theory) or to consider that it harms a collective interest ("public security," "public peace"). From our perspective, it is necessary to underline the collective wrongfulness embedded in a criminal organization and that, beyond the actual crimes committed, it questions the monopoly of violence exercised by the state. It represents the constitution of a violent organization that counters the basis of state political organization (arrogation of political organization). This approach opens a possibility to adequately define the offense of belonging to a criminal organization.</p>

      • abstractThe fight against dirty money and financial crimes in general is a very high priority for the EU - increasingly often on the top of the agenda - in the integration mission to establish a genuine, crime free, European space. Especially, the EC has frequently addressed the problem of white collar crime, accusing it of undermining the confidence in the market and thereby hampering the smooth running and full effectiveness of it. A considerable crux in this EC ‘tough on crime’ approach has, however, been the lack of a legislative competence, at the supranational level. Nonetheless, recently the landmark ruling of C-176/03, Commission v. Council, came partly to the rescue. More specifically, this case set the constitutional snowball rolling, bringing with it a range of dormant/latent EC proposals eagerly suggesting a criminal law competence. This paper provides a critical analysis of current developments in the area of financial crimes by discussing the federal scope of art 95 EC and art 5 (1) EC.
