      • abstract<p>The traditional areas of focus for the EU are those concerning the internal and external markets. Just over a decade ago this competence was extended to cover the area of freedom, security and justice (AFSJ), including fundamental rights. Th e creation of this new area will be the starting point of this paper. The drive behind this area’s development has been a principle taken from the internal market, the principle of mutual recognition. This principle is best exemplified by the Framework Decision on the European Arrest Warrant (EAWFD),  which the EU has used as a blueprint for subsequent mutual recognition measures in criminal matters. The second part of this paper will set out the key features of the EAWFD, the positives and its critics’ key concerns. The implementation of the EAWFD by the Republic of Cyprus (Cyprus) will further highlight the issues which it raises, as well as Cyprus’s optimistic Europhile attitude. Human rights, or rather the absence of explicit human rights in the EAWFD has been at the centre of most critique and will form  the focus of the third part of this paper, including the positioning of the relevant human rights in Cyprus and the EU’s recent endeavours to balance security and liberty.</p> <p></p> <p></p>

      • abstract   This chapter will start with a  general overview of the Belgian system. After briefly discussing the principal substitute solutions for corporate criminal liability, it will focus on the regime of corporate criminal liability that was created in 1999. It will analyse its scope of application, the peculiar issue of concurring liability, and the penalties. It will then turn to the Dutch system and it will pay special attention to the similarities and dissimilarities with  the Belgian liability regime.

      • abstract<p style="text-align: justify;">This paper explores the way in which the concept of due process is used and understood in contemporary criminal justice systems. In particular, ideas of due process and fair trial standards are discussed in both the context of international criminal procedure, and in the European Union perspectives. It aims at searching for answer to question about what kind of ' doing justice' is emerging in the contemporary criminal proceedings. This question seems to be of particular significance in view of the clear tendency towards globalised criminal justice of the 21 st century.</p>

It provides a guide of the rights protected under ECHR as well as a better understanding, open to supranational scenarios, of fundamental rights in the respective Constitutions. Our intention is not only to make available a mere case law commentary. This work indeed offers succinct information on the most consolidated lines of case law and this is probably where it is most useful. Nevertheless there is also academic reflection, which we believe is nowadays essential as Europe is becoming more than a continent: it is, above all, a civilisation, with a common language of rights, a developing ius commune.</p>
