      • abstract<p style="text-align: justify;">The right to silence, or the privilege against self-incrimination, has long been recognised as an important procedural protection for the accused in the criminal process. The legislature of New South Wales, however, has introduced legislation to curtail that right by allowing for adverse inferences to be drawn at trial from the pre-trial failure of the accused to mention a fact later relied on in his defence. This article considers this legislative change in comparative context, drawing on the experience of interference with the right to silence in the Republic of Ireland, in England and Wales and in the judgments of the European Court of Human Rights. Particular attention is paid to the interaction between the right to silence and the right to legal advice, including the issues of duty solicitor schemes, legal professional privilege and suspect reliance on advice to remain silent.</p>

      • abstract<p style="text-align: justify;">This article explores the right of access to a lawyer in criminal proceedings as a fundamental right in the European area. After noting the divergence of national legal systems in respect to the scope and practical exercise of this right, it discusses the ECtHR’s recent case-law on Article 6(3) c of the Convention and the EU-Directive, which was recently adopted. The lengthy debate over the Commission’s ambitious Proposal has highlighted five major issues, which are critically addressed in the text: time and scope of the right of access to a lawyer, derogations, confidentiality of communications, remedies, European Arrest Warrant proceedings. The article concludes that the Directive, though less strong than desirable in some respects, is a step forward on the long road to achieving effective defence in Europe.</p>

      • abstract<p style="text-align: justify;">This book arises from a three-year study of Preventive Justice directed by Professor Andrew Ashworth and Professor Lucia Zedner at the University of Oxford. The study seeks to develop an account of the principles and values that should guide and limit the state's use of preventive techniques that involve coercion against the individual.</p> <p style="text-align: justify;">States today are increasingly using criminal law or criminal law-like tools to try to prevent or reduce the risk of anticipated future harm. Such measures include criminalizing conduct at an early stage in order to allow authorities to intervene; incapacitating suspected future wrongdoers; and imposing extended sentences or indefinate on past wrongdoers on the basis of their predicted future conduct - all in the name of public protection and security.</p> <p style="text-align: justify;">The chief justification for the state's use of coercion is protecting the public from harm. Although the rationales and justifications of state punishment have been explored extensively, the scope, limits and principles of preventive justice have attracted little doctrinal or conceptual analysis. This book re-assesses the foundations for the range of coercive measures that states now take in the name of prevention and public protection, focussing particularly on coercive measures involving deprivation of liberty. It examines whether these measures are justified, whether they distort the proper boundaries between criminal and civil law, or whether they signal a larger change in the architecture of security. In so doing, it sets out to establish a framework for what we call 'Preventive Justice'.</p>

      • abstract<p style="text-align: justify;">In April 2010 a group of EU Member States proposed a Directive on the European Investigation Order, an instrument which, if adopted, will significantly change the way in which evidence is gathered at the EU level. After the failure of the EEW, which focused on the exchange of evidence which had already been gathered, the objective of the new text is to create a single instrument for obtaining all kinds of evidence located in another Member State. The aim of this paper is to examine, within the current framework, the suitability of this new instrument, with particular reference to its impact on the rights of defendants.</p>

      • abstract<p style="text-align: justify;">The completion of the second five-year term of the first European Data Protection Supervisor finds his office a quite different organisation than the one described, or even envisaged, in its establishment document back in 2001.1 As it will be immediately demonstrated, in particular the exercise of his consultative task (one of his three main tasks, together with supervision and co-operation) has transformed his office from a, perceivably, mostly controlling authority into an important, if not central, participant in the EU law-making process on all data protection matters. Although it is perhaps too early to assess whether this development is the result of external or internal factors, this analysis shall attempt exactly that: after briefly demonstrating the change that occurred in the EDPS office status, it shall attempt to analyse the factors that led to it. Finally, a third part shall discuss the future, particularly in view of the EU data protection reform package currently under way. </p>
