      • description<p>The purpose of <a href="http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex:32005L0035">Directive 2005/35/EC</a> and of this Directive is to approximate the definition of ship-source pollution offences committed by natural or legal persons, the scope of their liability and the criminal nature of penalties that can be imposed for such criminal offences by natural persons.</p> <p>On 23 October 2007 the Court of Justice of the European Communities <a href="http://eclan.eu/en/eu-case-law/commission-v-council-ship-source-pollution">annulled Council Framework Decision 2005/667/JHA of 12 July 2005</a> to strengthen the criminal-law framework for the enforcement of the law against ship-source pollution, which had supplemented Directive 2005/35/EC with criminal-law measures. This Directive should fill the legal vacuum following the judgment.</p>

      • description<p style="text-align: justify;">Full title: Initiative of the Kingdom of Belgium, the Republic of Bulgaria, the Czech Republic, the Kingdom of Denmark, the Republic of Estonia, the Hellenic Republic, the Kingdom of Spain, the French Republic, the Republic of Latvia, thr Republic of Lithuania, Republic of Hungary, the Kingdom of the Netherlands, Romania, the Republic of Slovenia, the Slovak Republic and the Kingdom of Sweden for a Council Framework Decision 2009/…/JHA of … on transfer of proceedings in criminal matters.</p> <p style="text-align: justify;">An agreement between the Member States of the European Communities on the transfer of proceedings in criminal matters was signed in 1990. That agreement has, however, not entered into force due to a lack of ratifications.</p> <p style="text-align: justify;">Consequently, no uniform procedure has been applied to cooperation between Member States regarding transfer of proceedings.</p> <p style="text-align: justify;">This Framework Decision should establish a common legal framework for the transfer of criminal proceedings between the Member States. The measures provided for in the Framework Decision should be aimed at extending cooperation between competent authorities of the Member States with an instrument which increases efficiency in criminal proceedings and improves the proper administration of justice, by establishing common rules regulating the conditions under which criminal proceedings initiated in one Member State may be transferred to another Member State.</p> <p style="text-align: justify;">Common rules between the Member States regarding the transfer of proceedings would help to prevent infringements of the ne bis in idem principle and support the work of Eurojust. Furthermore, in an area of freedom, security and justice there should be a common legal framework for the transfer of proceedings between Member States.</p> <br />

      • descriptionThis legislative proposal, submitted in June 2009 by 16 Member States (BE, BG, CZ, DK, EE, GR, ES, FR, LT, LV, HU, NL, RO, SI, SK, SE), aims at creating an explicit legal basis at EU level for the transfer of criminal proceedings from one Member State to another Member State. It would replace among the Member States the European Convention on the Transfer of Proceedings in Criminal Matters of 15 May 1972 (Council of Europe) which has been poorly ratified by EU Member States.<br /> <br /> The negotiation was not finalised before the entry into force of the Lisbon Treaty. Therefore, for reactivating the negotiations (and this time with the European Parliament as well) a new proposal would have to be tabled under the Lisbon Treaty.

      • titleCommunication from the Commission to the Council, the European Parliament - Justice, freedom and security in europe since 2005: an evaluation of The Hague programme and action plan
      • description<p style="text-align: justify;">In this communication, the Commission presents the evaluations of the implementation of the Hague Programme at both the EU and Member State levels as well as the themes to guide future action within the next multiannual programme (the Stockholm Programme).</p> <p style="text-align: justify;">Initiatives in the field of justice, freedom and security are relatively recent compared to other actions taken at the EU-level. Nevertheless, progress has been achieved on a number of measures, such as on the protection of fundamental rights, asylum and immigration policies, border management and visa policy, anti-terrorism and the fight against crime, as well as police cooperation.</p> <p style="text-align: justify;">The realisation of a European area of justice has also progressed, especially through improved cross-border judicial cooperation in both civil and criminal matters. Significant progress has been made in particular on the legislative and operational aspects of the principle on mutual recognition, which is the cornerstone of judicial cooperation.</p> <p style="text-align: justify;">While the fight against drugs has also been effective, drug use in certain Member States has increased.</p> <p style="text-align: justify;">Less progress has been made on the rights of EU citizens, in particular due to the deficient transposition by Member States of Directive 2004/38/EC on the free movement of citizens within the Union.</p> <p style="text-align: justify;">In general though, most of the specific measures set out in the Hague Programme have been adopted, though the full impact of many of them will be realised only in the longer term. Nevertheless, due to the specific nature of the justice, freedom and security policy area, progress has been relatively uneven. For example, decision-making under the “third pillar” has been slow and at times limiting the desired outcomes. In addition, transposition by Member States of legislative instruments falling under the “third pillar” is often delayed and no recourse exists for formal infringement procedures. The Lisbon Treaty, once in effect, should speed up decision-making, while future action should focus on consolidating and enforcing the existing legal framework.</p>

      • description<p style="text-align: justify;">This Decision replaces the <a href="http://eclan.eu/en/eu-legislatory/convention-of-26-july-1995-on-the-establishment-of-a-european-police-office-europol-convention">Europol Convention</a>. Apart from the change of legal nature, differences between the new Decision and the Europol Convention are limited. They include an extension of the competence of Europol (abolition of the requirement of the existence of a criminal organisation involved in the case concerned). A major change is also that Europol will be funded by the EU and not by the Member States as in the Europol convention. Europol's staff will be subject to the EU's Staff regulations.</p> <p style="text-align: justify;">The entry into force of the Regulation of the European Parliament and of the Council on the European Union Agency for Law Enforcement Cooperation and Training (Europol) [COM(2013)173 final of 27.3.2013] will repeal all previous decisions.</p>

This was with a view to preventing criminals escaping their past by moving to a different EU country from that in which they were convicted.</p> <p style="text-align: justify;">The framework decision sets out the general principles for the functioning of the system alongside <a href="http://eclan.eu/en/eu-legislatory/council-decision-2009-316-jha-of-6-april-2009-on-the-establishment-of-the-european-criminal-records-information-system-ecris-in-application-of-article-11-of-framework-decision-2009-315-jha">Council Decision 2009/316/JHA</a>, which established the European Criminal Records Information System (ECRIS).</p> <p style="text-align: justify;">This Framework Decision repeals <a href="http://eur-lex.europa.eu/legal-content/EN/ALL/?uri=CELEX:32005D0876">Decision 2005/876/JHA</a>.<br />  </p>
