      • description<p style="text-align: justify;">The United Kingdom applied to the Court for annulment, submitting on the contrary, as its main plea, that Decision 2008/633/JHA (access of the Visa Information System by national authorities and Europol for the purposes of the prevention, detection and investigation of terrorist offences and of other serious criminal offences) was not a measure building on the Schengen acquis, but a police cooperation measure in which therefore it should have been permitted to take part.</p> <p style="text-align: justify;">The United Kingdom submits in the alternative that even supposing that it does constitute a development of the Schengen acquis, the legal base did not fall within the area of this acquis covering short-stay visas and that that did not justify its exclusion from that measure. Consequently, it demanded direct and full access to the VIS.</p> <p style="text-align: justify;"></p> <p style="text-align: justify;">The Court rejected the action of the United Kingdom, considering, in substance, that an act may have "police cooperation" as its legal base, whilst constituting a development of the Schengen acquis. In this respect, it emphasised that the question whether a measure constitutes a development of the Schengen acquis is separate from that of the legal base on which that development must be founded.</p>

On its basis the person concerned was put into custody in Belgium where he had become a resident for some years. In order to avoid his return to Romania he applied for asylum in Belgium; at the date of issue of the CJ judgement, these proceedings had not yet led to a final decision. But the competent criminal court raised doubts whether its interpretation of the Framework Decision – that in the circumstances of this case Article 5 (1) of the FD seemed not to allow the convicted person to serve his sentence in the Member State of his residence – did infringe fundamental rights, in particular the prohibition of discrimination and referred to CJ.</span></p> <p style="margin:0cm;margin-bottom:.0001pt;text-align:justify;line-height:14.4pt; background:#FBFBFB"><span lang="EN-US" style="font-size: 9.5pt; font-family: Verdana, sans-serif;"><o:p></o:p></span></p> <p style="margin:0cm;margin-bottom:.0001pt;text-align:justify;line-height:14.4pt; background:#FBFBFB"></p> <p style="margin: 0cm 0cm 0.0001pt; text-align: justify; line-height: 14.4pt; background: rgb(251, 251, 251);"><span lang="EN-US" style="font-size: 9.5pt; font-family: Verdana, sans-serif;">The Court ruled that Articles 4(6) and 5(3) of Council Framework Decision on the European arrest warrant and the surrender procedures between Member States must be interpreted as meaning that, where the executing Member State has implemented Articles 5(1) and Article 5(3) of that framework decision in its domestic legal system, the execution of a European arrest warrant issued for the purposes of execution of a sentence imposed in absentia within the meaning of Article 5(1) of the framework decision, may be subject to the condition that the person concerned, a national or resident of the executing Member State, should be returned to the executing State in order, as the case may be, to serve there the sentence passed against him, following a new trial organised in his presence in the issuing Member State.<o:p></o:p></span></p> <p style="margin-top: 1.5em; margin-bottom: 1.5em; font-family: Verdana, Tahoma, 'DejaVu Sans', sans-serif; font-size: 12.8px; line-height: 19.2px; text-align: justify; background-color: rgb(251, 251, 251);"></p>

      • description<p>The General Court annuls the regulation freezing Yassin Abdullah Kadi’s funds.</p> <p></p> <p>The regulation was adopted in breach of Mr Kadi’s rights of defence and constitutes an unjustified restriction of his right to property. </p> <p style="text-align: justify;">The reasoning of the General Court is particularly interesting on the degree of its review. </p> <p style="text-align: justify;">The General Court considers that, in light of the judgment of the Court of Justice in <i>Kadi</i>, its task is to ensure in this case a full and rigorous review of the lawfulness of the regulation, without affording the latter any immunity from jurisdiction on the ground that it gives effect to resolutions adopted by the UN Security Council. That must remain the case, at the very least, so long as the re-examination procedure operated by the Sanctions Committee clearly fails to offer guarantees of effective judicial protection, as the Court of Justice considered to be the case in its judgment in <i>Kadi</i>. The review must concern, indirectly, the substantive assessments of the Sanctions Committee itself and the evidence underlying them. Such a review is all the more justified given that the measures in question have had a marked and long-lasting effect on the fundamental rights of Mr Kadi, all of whose funds have been indefinitely frozen for nearly ten years now.</p> <p></p>
