      • description<p style="text-align: justify;">Following a thorough criminal investigation, the judicial authorities of one Member State (Belgium) refused a request to send the person under investigation for trial and instead made a finding of ‘non-lieu’ (roughly equivalent to ‘no case to answer’). That finding effectively terminated the (potential) prosecution before trial, but is capable in national law of being set aside in the light of new facts and/or evidence against the person concerned.</p> <p style="text-align: justify;">By its request for a preliminary ruling, the Tribunale di Fermo (District Court, Fermo) (Italy) wishes to know whether, under Article 54 of the Convention implementing the Schengen Agreement (‘CISA’), the ne bis in idem principle precludes that person being prosecuted for a crime arising out of the same facts in the criminal courts of another Member State.</p> <p style="text-align: justify;">The Court concludes that: "Article 54 of the Convention implementing the Schengen Agreement of 14 June 1985 (...), must be interpreted as meaning that an order making a finding that there is no ground to refer a case to a trial court which precludes, in the Contracting State in which that order was made, the bringing of new criminal proceedings in respect of the same acts against the person to whom that finding applies, unless new facts and/or evidence against that person come to light, must be considered to be a final judgment, for the purposes of that article, precluding new proceedings against the same person in respect of the same acts in another Contracting State."</p>

      • description<p style="text-align: justify;"> By Commission Regulation (EC) No 1629/2005 of 5 October 2005, the applicant’s name was added to the list in Annex I of Council Regulation (EC) No 881/2002 of 27 May 2002 and his assets and other financial resources were therefore frozen in the European Community.</p> <p style="text-align: justify;">By letter of 18 March 2010, referring to <a href="http://eclan.eu/en/eu-case-law/yassin-abdullah-kadi-and-al-barakaat-international-foundation-kadi-i-ecj">Kadi I</a>, the applicant called upon the Commission to remove his name from the list at issue and to urgently provide further information concerning the substantive basis for the inclusion of his name in the list at issue.</p> <p style="text-align: justify;">As the Commission did not reply to the applicant’s letter of 18 March 2010 within the period of two months laid down in Article 265 TFEU, the applicant brought the action pursuant to Article 265 TFEU.</p> <p style="text-align: justify;">The Court found that the Commission failed to respond effectively or adequately to the applicant’s letter of 18 March 2010, so that the Commission was in the position of having failed to act in that regard on 18 May 2010, following the expiry of the period of two months after having been called upon to act pursuant to that letter.</p> <p style="text-align: justify;">However, it cannot be excluded that, on the merits of the case, the retention of the applicant’s name on the list at issue may for all that prove to be justified, even in the light of the new evidence which the Commission must take into consideration. The failure to act held to have occurred does not therefore consist, as argued by the applicant, in a failure to revoke Regulation No 1629/2005, but in a more limited failure to observe the principles which apply in the procedure followed in the review of the applicant’s situation which has been requested.</p>

      • description<p style="text-align: justify;">The term ‘court having jurisdiction in particular in criminal matters’, set out in Article 1(a)(iii) of Council Framework Decision 2005/214/JHA of 24 February 2005 on the application of the principle of mutual recognition to financial penalties, is an autonomous concept of Union law and must be interpreted as covering any court or tribunal which applies a procedure that satisfies the essential characteristics of criminal procedure.</p> <p style="text-align: justify;">Article 1(a)(iii) must be interpreted as meaning that a person is to be regarded as having had the opportunity to have a case tried before a court having jurisdiction in particular in criminal matters in the situation where, prior to bringing his appeal, that person was required to comply with a pre-litigation administrative procedure. Such a court must have full jurisdiction to examine the case as regards both the legal assessment and the factual circumstances.</p>
